Gustavson introduces Nevada Liberty Preservation Act

CARSON CITY – Nevada State Senator Don Gustavson (R-Dist. 14) has introduced Senate Bill 378, legislation that would hinder the federal government’s ability to apply indefinite detention provisions under the National Defense Authorization Act (NDAA). Gustavson said a portion of the NDAA enables a precarious precedent that allows the federal government the freedom to encroach on liberties that are guaranteed to residents living in Nevada.

“Passage of this bill will assert our rights,” said Gustavson. “We’re putting the feds on notice that their power to deprive our constitutionally protected rights to due process, habeas corpus and assistance of counsel is being rebuffed.”

Gustavson said that passage of Senate Bill 378 would safeguard protections granted under Nevada’s Constitution and the First, Fourth, Fifth, Sixth, Eighth and Fourteenth Amendments of the U.S. Constitution.

“Your liberties, your property, even your life is at risk here. If the federal government says you have violated a law, it is their responsibility under due process to prove their case beyond a reasonable doubt to a jury of your peers.”

Gustavson’s bill, labeled the “Nevada Liberty Preservation Act,” was referred to the Senate Committee on Judiciary. Similar measures are being considered in several other states.

Don Gustavson serves Senate District 14 – Washoe, Esmeralda, Humboldt, Lander, Mineral, Nye and Pershing counties.
